False.  My company is privately held and we don't give a fuck about quarterly numbers.  Haven't for the 15 years its been in business.

We do monitor cash flow and revenues and spend a fair amount of time on revenue projections and the impact of various decisions on revenues.

Many of those same whales are great players, but so jaded. I pity any new player crossing their path.  Granted, this was probably pretty rare.  If they believe doing this will increase new player retention, I sorta get it on some level though I still think it's flawed.

Depends on how it is written and implemented.   If it is a link then, not so much.  If you can bypass it without accepting it then not so much.  If it displays on the screen and requires you to scroll it and click accept, then good luck with that. 

Sure, it can be considered a contract of adhesion.  But you would have to prove that it violated the Doctrine of Unconscionability.   

If the user in question was a young minor or mentally disabled that would be something.   Otherwise you would need to look for terms that were unreasonably one-sided. 

I'm not sure that you are going to convince people that "if you willingly cheat at the game we can terminate your game account" would be considered unreasonable. 

Like I said, good luck.  Sounds like a waste of time and money to me.   You aren't the victim in this story.   You broke the rules.  Own it.  Quit being a crybaby and move on.

So do I.  A Cloud based/moble software development company.  And I've had our TOS and EULA's enforced by a court more than once.   It's all in the verbiage and how you can prove they read and accepted it.   Blanket, one size fits all statements about EULA's are reductive.   Just because company X's EULA wasn't enforceable doesn't mean all EULA's aren't enforceable.  That's an ignorant statement based on the fallacy of composition. For example, if a person travels through a town for the first time and sees 5 people, all of them children, they may erroneously conclude that there are no adult residents in the town.

I've worked for two privately-held companies now, both celebrated quarter-end like major holidays. Based on conversations with the guys on the business side, that seems to be the norm rather than the exception.
  

I'll never understand the propensity of people to brag about being good at a video game. Its a toy you play with for fun. The only person who should be proud of you is your mother. If you're 3.

Probably depends on the nature of the business.   I'm in a cloud computing with annuity stream revenues.   I care more about how many active contracts I have, how many new clients are coming in, how many renewals we have coming up in the next 6 months, and the risk associated with them renewing or not.  We use 6 month and 24 month rolling trend lines on all of it.

Be intertesting to find out how well-written or implemented SSG's EULA is. Tongue lol Can see where that could bite them in the ass.

MMO EULAs have been thrown out plenty of times in the past. One wonders whether it was written by the company lawyer(who knows how to make it legally binding) or the community manager(who knows how to take the EULA from another game and do a find-and-replace).

What make do you think anyone in GoDS was banned? As far as I knew nobody in Cannith was banned, until someone here said Cap was banned (nobody yes door). Not suprised by that, nobody in Cannith exploited this last bug, except those from very small guilds and that only play alone or with a small group of closed friends like the guy above, so these don't matter for the server after all.

Haven't been logging in, so not sure about the honeypot exploit or who was using it - but there were a ton of exploiters active on Cannith (very obviously so, if you know what to look for).

Like you said, they're mostly smaller guilds who are tight lipped about it...with the one exception.

  

Turbine policy - glitches and poor coding resulting in interference of your game play or enjoyment will be ignored.  Glitches or poor coding on the developers side that at all benefit your game play or enjoyment will result in your character being banned and/or items from your inventory deleted.  Please report all bugs via our bug report...when it works.

I'll have to confess that seeing some of these character names disappear from existence by the most severe ban hammer ever known to DDO Exploiters Anonymous, those very same names who have publicly criticized me and my guild mates for partaking in interpretive gameplay in the past, makes me pretty damn happy.

As a present for making my Saturday morning so pleasant, please let me know if you need some extra dragon scales on your first life back up through GH. I'm here for you in your time of need.

in ProCD v. Zeidenberg, the license was ruled enforceable because it was necessary for the customer to assent to the terms of the agreement by clicking on an "I Agree" button in order to install the software. In Specht v. Netscape Communications Corp., however, the licensee was able to download and install the software without first being required to review and positively assent to the terms of the agreement, and so the license was held to be unenforceable.
