Deleted Characters (massive amounts). Open Letter to SSG

I have just been informed by some guild members that a number of my characters have been deleted. I would like to give standing stone games a chance to restore these characters before i go file a lawsuit in small claims court in Nova Scotia, Canada for the MAXIMUM allowed claim of $25,000.

Now before you go quoting the ToS or anything like that think about this for a few moments.

    - So called 'exploits' have happened before in this game?*

    - During these 'exploits' Standing Stone Games has “coincidentally” put the corresponding items to compliment said 'exploit' on sale in the store, such as Storage (bags, bank, shared, xp pots, ottos boxes, etc). This is easily proven.?*

    - Standing Stone Games knew about the current Saga Stone “exploit” back before December but instead of turning it off they allowed it to happen and even put Experience Elixirs on sale.?*

    - I have a former employee of Turbine/Standing Stone Games that will testify to the fact that the company has profited from these “exploits” in the past and has even put somethings on-sale because of the “exploits”?*

    - I have used Otto's Boxes on some of the deleted characters, this means I paid money for boxes and have items I bought Legendary Raid Bypass Timers to get and regular Raid Bypass Timers to get, this means spending real money and you have just destroyed these items?*

    - I have many Ravenloft items on my deleted characters that I paid money to farm, these are no longer accessible to me so I have paid for items and services I can no longer access.?*

    - ToS and Terms of Service are routinely thrown out in court (I know this from personal research and from talking to my cousin who is a rather high-priced lawyer). If you ask your in-house legal council about these they will probably look at you with a “What were you thinking” look on their faces.?*

    - Also, ask your in-house legal council about the cost of responding to a lawsuit vs simply restoring my characters. You should really also think about all the other people that will be filing lawsuits as well, its not going to be a small amount, I know some of the ones banned. I don't think Standing Stone Games quite realizes the scope of what they have done or started.

Now, immediately, permanently and fully restore my deleted characters as well as remove the suspension and I shall take no action.

Memnir:

Did you exploit? Were the deletions totally unwarranted, or did you knowingly cheat and expect no repercussion?

Because if you did exploit and if you cheated - then I don't think you've got a leg to stand on. But if you do want to sue, especially if you did exploit, - good luck and keep us updated every step of the way. I could use the laugh.

Somehow I don't think SSG has thought that far ahead. Come end of Q2 2018 they will be looking at the numbers and really confused as to why the sales dropped off so suddenly.

It is funny, but I think he may have a point there: if you legitimately bought something like an Otto's Box that has a clear real-money value, then it got taken away, aren't you entitled to a refund? Even if you violated the TOS?

Glad I stayed in my own guild...

Sorry to see so many good players get the ax.

The only ways I see myself leaving DDO would be if the game shuts down, if I get permabanned, or if they delete my characters.

This game builds in too much grind to start over. Fuck that shit.

PM him on the Motherboards, though if you don't already live in Canada it'll be tough to cooperate.

That said, could legitimately file your own suit.

Unlikely.   Small business owners are probably more focused on cash flow and revenue than larger ones.  Not less focused.   Also end of quarter reporting is publicly traded concept.   SSG is privately owned.  They don't even have to file a 10-K.   Just an annual tax return.  There might be some internal reporting their shareholders decide they want to look at monthly or quarterly or whatever, but who knows.

Come end of Q2, expect to see Ravenloft Ultimate Fan pack discounted 75%.

Even if they are privately-traded they would still look at figures on a quarterly-basis. Even if they don't do it "quarterly", someone there is tracking cash-flow and will notice the drop-off. I know I for one definitely won't be spending another dime on this game, but that's actually a decision made months ago and not connected to this. This whole incident just reinforces my decision.

Oh I do have a valid point.   Got $200 setting on my desk for the fees at the moment.   Worst case its great entertainment and $200 lost.   Best case i'm laughing to the bank with $25,000.

No.  Read the EULA.  You knowingly and willingly bypass game mechanics and you are in breach of contract.   Their stated remedy for your willful breach, in the contract you affirmatively agreed to, is to permanently terminate your account.

You legally agreed that if you ever exploit that you agree they can delete your account and ban you.

It's that simple.   The only possible avenue would be if you could prove that you were banned in error and were not actually exploiting.   Good luck with that.

Typical Turbine logic - "hey, we have a ton of new players.  Let's set up a sting and ban a ton of the whales that have kept us in business for the last decade, because I'm sure all these new players are totally going to stick with the game and not get bored and go play something better in the next 6 months."

Turbine policy - glitches and poor coding resulting in interference of your game play or enjoyment will be ignored.  Glitches or poor coding on the developers side that at all benefit your game play or enjoyment will result in your character being banned and/or items from your inventory deleted.  Please report all bugs via our bug report...when it works.

I own a company and trust me TOS and EULA doesn't mean shit.  SSG has opened themselves up to major lawsuits.  The courts have already ruled on this as well as stating that in-game items have real-life value.  Whether or not you agree with that it's the facts.
